FARM RULES
1. No Smoking/vaping anywhere on the property
2. No Dogs are permitted on the property.
3. Speed limit on the entire property is 5mph
4. Please sign in and out for all lessons. If your teen is doing volunteer shift, please walk them up and let an instructor know that you are dropping/picking up.
5. Children that are not signed up for classes must always stay with parent and away from animals
6. During lessons we ask that parents/siblings remain in the seating areas and out of the horse tack up/near the arena so the teachers and students can focus on their riding time without any distractions.
7. No early drop off for classes, and please be on time for pick up.
8. ALL VISITORS must sign a release of liability
9. No feeding any animals without permission
10. No handling of any animals is permitted unless you are in a class or have been approved by Mighty Minds.
For students that are in a weekly set lesson:
We invoice by the month if you are private pay or the Qtr if using ESA CW funds. For the monthly billing you can pay as you go from your invoice or all at once, but classes must pre-paid before the start of your weekly class. If you are using ESA and waiting for funding, please email us so we can split up your invoice so you can pay a portion of the class until your future qtr funding hits. If using CW please send us a copy of the submitted invoice for your file before your class starts. We offer 1 make up class per qtr (can be used in one of the approved group classes or towards a day at school break camp). We require you to let us know if your child isn’t coming to class 24 hours in advance so we can open up that space for a make-up or trial class, and this keeps the teachers/class from waiting to see if your student will arrive arrive. Your lesson spot is your set spot for the school year, If you wish to drop your weekly class, we ask for 30 days notice so we can fill that space. We are not able to offer refunds but can offer credit towards another class/lesson if you have paid beyond that 30 days notice.
What to Bring:
We are an outdoor program, please dress kids/teens/adults accordingly with layers, sun protection, closed toe shoes, sunblock and anything they may need for weather changes. Please send a clearly labeled refillable water bottle, snacks and lunch if applicable. In the group classes they move around a ton and are always hungry! A small, labeled bag with extra clothing is never a bad idea if it’s a wet day or hot day (we love sprinklers). We provide certified equine helmets, if you prefer to bring your own, please make sure it’s a certified, non-expired equestrian helmet (no bike/skate helmets are permitted).
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT, YOUR SIGNATURE INDICATES THAT YOU UNDERSTAND IT AND AGREE TO ITS TERMS. BY SIGNING THIS AGREEMENT YOU (AND YOUR CHILD) ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR RECOVER DAMAGES IN CASE OF INJURY, DEATH OR PROPERTY DAMAGES, FOR ANY REASON, INCLUDING BUT NOT LIMITED TO, THE NEGLIGENCE OF THE STABLE, MIGHTY MINDS LLC, ITS OWNERS, INSTRUCTORS, EMPLOYEES, VOLUNTEERS AND AGENTS (THE “RELEASEES”).
On behalf of myself (and my minor children listed. In consideration for allowing me (or my minor child) to handle and ride a horse and on behalf of myself, my child or our personal representatives, heirs, next-of-kin, spouses and assigns, I HEREBY:
1. Acknowledge that a horse may, without warning or any apparent cause, buck, stumble, trip, roll, fall, rear, bite, kick, run, make unpredictable movements, spook, jump obstacles, step on a person’s feet, push or shove a person, saddle or bridles may loosen or break – all of which may cause the rider to fall to the ground to be jolted, resulting in serious injury or death.
2. I am responsible for any vet bills or fees incurred while riding any Mighty Minds/Mizenko owned or leased horses if it is cause by negligence while on the property of Madella Ranch or off the property trail riding or traveling to a riding destination
3. ACKNOWLEDGE THAT HORSEBACK RIDING IS AN INHERENTLY DANGEROUS ACTIVITY AND INVOLVES RISKS THAT MAY CAUSE SERIOUS INJURY AND IN SOME CASES DEATH, because of the unpredictable nature and irrational behavior of horses, regardless of the extent of their training and past performance.
4. Voluntarily assume all of the risk and danger of injury or death inherent in the handling or riding of the horse, and use of saddles, bridles, equipment and gear provided by the Releasees.
5. Release, discharge and promise not to sue the Releasees for any loss, damage, injury (including death) or cost to me or my child’s person or property arising out of riding or handling a horse, or use of saddles, bridles, equipment or gear provided by Releasees.
6. Release the Releasees from any claim that the Releasees were negligent in connection with my or my child riding a horse, including but not limited to, training or selecting horses, maintenance, care, fit or adjusting of saddles or bridles, instruction on riding skills or leading and supervising riders, which results in loss, damage, injury or death.
7. Indemnify, and save and hold harmless the Releasees from and against any loss, liability, damage or cost they may incur arising out of or in any way connected with either my or my child’s handling or riding the horse and/or use of any saddles, bridles, equipment or gear provided therewith resulting from or contributed to by my own negligence.
8. Expressly agree that the foregoing release and assumption of risk, and indemnity agreement is governed by the laws of the State of Arizona and is intended to be as broad and inclusive as is permitted by Arizona law, and that in the event any portion of this Agreement is determined to be invalid or unenforceable for any reason, the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.
9. Acknowledge that this document is a contract and agree that if a lawsuit is filed against the Releasees for any injury or damage in breach of this contract, I will pay all attorneys fees and costs incurred by the Releasees in defending such an action.
10. IT IS REQUIRED THAT ALL RIDERS WEAR A PROTECTIVE HELMET. IT IS MY UNDERSTANDING THAT A PROTECTIVE HELMET IS AVAILABLE AND HAS BEEN OFFERED FOR MY OWN OR MY CHILD’S SAFETY.
11. If the person who is to enter into this Agreement is under eighteen (18) years of age, his/her parent or guardian must read this Agreement and sign below on behalf of the minor. I am responsible for watching my children and their safety at all times while on the farm or trails with the Mighty Minds owned/leased horses or horses on the Medella Vina Ranch property.
12. No dogs are allowed at the farm.
13. In case of an injury, I give my permission to have an ambulance called and to be medially treaded s deemed necessary by the medical professionals and will be responsible for all medical bills received. I will provide a copy of my health insurance to Mighty Minds.
14. Mighty Minds LLC runs a youtube channel and social media for advertising our programs, and educational videos. I give permission for use of videos and photos for such purposes. If you need to request to opt out, kindly email us.
I HAVE READ THIS DOCUMENT. I UNDERSTAND IT IS A PROMISE NOT TO SUE AND TO RELEASE THE STABLE, MVR, MIGHTY MINDS LLC, ITS OWNERS, INSTRUCTORS,EMPLOYEES, VOLUNTEERS,AND AGENTS, FOR ALL CLAIMS.I HAVE MADE A FREE AND DELIBERATE CHOICE TO SIGN THIS RELEASE AND WAIVER AS A CONDITION TO RELEASEES ALLOWING ME OR MY CHILD TO RIDE OR HANDLE A HORSE. I HAVE CONCLUDED THAT THE RISKS INVOLVED AND THE RELEASE AND WAIVER OF LIABILITY IS WORTH THE PLEASURE OF A HORSEBACK RIDING EXPERIENCE. EQUESTRIAN RELEASE OF LIABILITY Under Arizona Law, an equine owner or agent who allows another person to take control of an equine (horse, pony, mule, donkey or ass) is not liable for injury or death of the person resulting from the inherent risks of equine activities, pursuant to Section 12-533 of Arizona Revised Statutes.
